What is a Medical Cannabis Caregiver?
A “caregiver” is a person designated by an approved WV OMC patient and is also approved by WV OMC who is able to obtain medical cannabis from approved dispensaries in the state and deliver the medical cannabis to the patient.
Under the WV Medical Cannabis Act a “caregiver” is an individual, 21 years of age or older unless otherwise authorized by the WV OMC, who is
Designated by a patient or, if the patient is under 18 years of age, an individual that is a parent or legal guardian of the patient, or
An individual designated by a patient or legal guardian, or
An appropriate individual approved by the OMC upon sufficient showing that no parent or legal guardian is appropriate or available.
Caregivers must submit an application online to the WV OMC for a caregiver card and undergo a criminal history background check.
CHOOSING A CAREGIVER
A caregiver is a person who can buy, transport, possess, and administrate medical cannabis to a WV OMC patient.
This person is designated by the patient to care for their needs. This can be a parent, guardian, nurse, spouse or any applicable significant other.
Note: Patients under the age of 18 are required to have a parent or legal representative serve as their caregiver. These caregivers must also submit an application to the WV OMC and be approved before they can assist the patient.
